{"id":1691,"date":"2026-06-26T17:00:10","date_gmt":"2026-06-26T17:00:10","guid":{"rendered":"https:\/\/youcheckinn.com\/?p=1691"},"modified":"2026-06-26T15:04:05","modified_gmt":"2026-06-26T15:04:05","slug":"youcheckinn-vous-aide-a-comprendre-la-loi-hoguet-en-location-courte-duree","status":"publish","type":"post","link":"https:\/\/youcheckinn.com\/en\/youcheckinn-vous-aide-a-comprendre-la-loi-hoguet-en-location-courte-duree\/","title":{"rendered":"The Hoguet Law: what the law really says about short-term rentals"},"content":{"rendered":"<p class=\"wp-block-paragraph\">When we talk about short-term rentals, our first thought turns to the known rules: declaration at the town hall, the 120-day limit, taxation...<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, there is a point that is often overlooked: as soon as an intermediary becomes involved in property management, another legal framework applies: the Hoguet Law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Hoguet law applies to anyone who habitually intervenes on the property of a third party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This applies to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Rental or subletting<\/li>\n\n\n\n<li>Holiday let<\/li>\n\n\n\n<li>the management of a property<\/li>\n\n\n\n<li>or a mediating role<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In short: as soon as you are not managing your own property, you could be affected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Is short-term rental included?&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law defines seasonal rental as a non-renewable rental of a maximum of 90 days. As soon as there is a management mandate, the activity is therefore considered to be property management.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So no, the short duration is not outside the scope and can fully fall within the remit of the law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The real issue: who are you acting for?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;If you manage your own property \u2192 there is no problem<br>If you are intervening for someone, be careful, as what seems to be a simple service could actually become a regulated activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concretely, this could be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>manage bookings<\/li>\n\n\n\n<li>organise stays<\/li>\n\n\n\n<li>to collect rent<\/li>\n\n\n\n<li>manage a property<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Very concrete obligations<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you are concerned, you cannot pretend that nothing is wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law generally requires:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A professional card issued by the Chamber of Commerce and Industry<\/li>\n\n\n\n<li>professional indemnity insurance<\/li>\n\n\n\n<li>a financial guarantee (in the case of fund management)<\/li>\n\n\n\n<li>A written mandate with the owner<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">No sum can be requested before the official completion of the transaction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Money: the real tipping point<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As soon as funds are handled, the rules become significantly stricter: it is no longer a simple service, but a strictly regulated activity.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Administrative obligations<\/li>\n\n\n\n<li>accurate tracking<\/li>\n\n\n\n<li>Mandatory supporting documents<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;It is no longer a simple service, but a strictly regulated activity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Real sanctions if this is not respected<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One might think that this framework is theoretical. In reality, the sanctions are very concrete:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>up to 6 months in prison and a \u20ac7,500 fine<\/li>\n\n\n\n<li>up to 2 years and \u20ac30,000 in some cases<\/li>\n\n\n\n<li>contracts called into question<\/li>\n\n\n\n<li>liability incurred, even for a company<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key takeaways<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Hoguet law is not an administrative detail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It applies as soon as you act on behalf of a third party, lays down precise rules and directly engages your responsibility<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Short-term lets may be affected.
