GENERAL TERMS AND CONDITIONS OF SALE AND USE OF THE YOU CHECKINN SERVICE

(Effective from 1st September 2025)

The YOU CHECKINN ® services are designed and managed by the company CONTROLH SAS, located at 142 avenue de Rivoli 75001 Paris – RCS of Paris. SIREN No. 941 858 706. SIRET No. 941 858 706 00026.

The Publication Director is Pierre MIGNAVAL.

CONTROLH SAS grants the user the right to use the web service and/or to download and use the mobile application YOUCHECKINN ®.

The YOU CHECKINN ® mobile application provides optimised and secure services for the transfer and electronic processing of various types of media, geolocated, time-stamped at various levels, and linked to the account holder.

These timestamps are validated by the issuance of a blockchain certificate certified by a Judicial Officer affiliated with YOU CHECKINN ®.

To use the YOU CHECKINN ® services, the user must register and accept these terms and conditions. Acceptance of these terms and conditions constitutes a contract between the user and CONTROLH SAS for an indefinite period from the acceptance of these general terms and conditions of sale and use (hereinafter «GTCS/GTU»). Any user is deemed to have accepted these contracts by the mere fact of using the services.

These T&Cs/T&Us define the contractual conditions exclusively applicable to any subscription and use of the YOUCHECKINN ® services by a user, whether by themselves or by any person to whom they would give their login details, via the website and the mobile application. By connecting to the YOU CHECKINN ® services, the user unreservedly accepts these rules.

The YOU CHECKINN ® services can be consulted on the website accessible at https://www.youcheckinn.com, hereinafter referred to as «the Site», and via the YOU CHECKINN ® mobile application downloadable on a smartphone.

YOU CHECKINN ® reserves the right to amend these T&Cs/T&Us, the mobile application, and the website https://www.youcheckinn.com at any time as it deems necessary and useful.

By doing so, all users are deemed to have accepted these changes from the moment they use the YOUCHECKINN® services.

I - DEFINITIONS

Here are the meanings of the terms below:

Blockchain: Distributed registry technology that enables all its users, who are also holders, to record information according to specific rules established by a secure computer protocol using cryptography.

User : Any natural or legal person who accesses the website or mobile application and holds an account. Users may create user sub-accounts enabling third-party partners to use the services under their sole responsibility.

User sub-account : Sub-account opened by the user to enable third-party partners with whom he works (employees, sub-contractors) to use the services. The user sub-account is opened, closed and operates under the exclusive responsibility of the user and is attached to the user's account.

Provider : The provider is defined as the company CONTROLH SAS (designer and distributor of the service, subject to these T&Cs, via its application: YOU CHECKINN ®).

Internet access : service enabling users to access the Internet and its various services;

Identifiers : confidential and personal access codes enabling the user to connect to the Platform and authenticate on the Mobile Application.

Platform / Site : the web space offering the YOU CHECKINN ® services at the address https://www.youcheckinn.com and via the mobile application allowing access, using the Identifiers, to the secure and personal space dedicated to the user.

Mobile application : the mobile application downloadable onto a mobile device from a download platform and allowing users to access, via their mobile device, the YOU CHECKINN ® services as defined in Article 3 of the GCS/T&Cs below.

Partner Justice Commissioner : A public official exercising the profession of Commissaire de Justice in accordance with the laws and regulations applicable to his profession who has entered into a partnership agreement with CONTROLH SAS.

Account / Customer Area : The application interface allowing a YOUCHECKINN® services user to access the functionalities described in these T&Cs/T&Us.

Contents: any text, software, script, graphic, photo, sound, music, video, PowerPoint presentation or audiovisual combination, whether or not protected by intellectual property rights.

Identification document : refers to all documents authorising the right to use the YOU CHECKINN ® services, such as a mobile phone number, an email address, a copy of an identity card or passport, or the legal representative's residence permit.

It could also be a copy of a Kbis extract or a company electricity or telephone bill, although this list is not exhaustive.

II - ACCEPTANCE OF THE GCV/CGU

By consulting or using the mobile application and the website in any way whatsoever, you fully accept these GTC/GTC.

III - SERVICES YOU CHECKINN

YOU CHECKINN® offers a paperless, blockchain-certified, and adversarial inventory of fixtures solution.

YOU CHECKINN ® allows anyone who uses it to:

If he is the owner, to draw up a dematerialised inventory of fixtures for the premises, and to correct or amend it if necessary.

If they are a tenant, to accept the inventory of fixtures, or to comment on it, amend it or refuse it, and to pass on their position to the owner who drew it up, who will take the necessary action on the basis of the feedback.

The services provided by YOU CHECKINN ® include the following:

A/ PROVISION OF AN APPLICATION

It can be used and/or downloaded from the Internet, a computer, a smartphone or a tablet to produce a «preliminary» inventory of fixtures and fittings and to illustrate it with comments, photos and/or videos and inventories.

The inventory of fixtures created in this way is offered to the tenant, who can check it on entering the premises, make minor corrections and add photos and/or videos.

These elements are immediately sent to the owner, who must respond appropriately to any inconsistencies between the original inventory and the observations made by the tenant on arrival.

Throughout the process, the YOU CHECKINN ® application certifies the integrity of the entered data or photographs taken on site. All elements constituting the inventory of fixtures are geolocated, time-stamped, and certified using blockchain technology, thereby guaranteeing the authenticity and immutability of all information collected. It is not possible to modify or alter the entry of documents, data, and photographs once they have been saved in the application, which offers an additional guarantee of integrity and transparency.

The inventory of fixtures and any amendments to it are stored in the digital safe of a court commissioner, who can draw up a statement of deposit at any time.

B/ PROVISION OF TECHNICAL INFORMATION

As an option, the owner may also provide the tenant with information on the operation of the facilities and/or instructions for use, or with the contact details of the service companies with which it has contracted.

C/ PROVISION OF TOURIST, CULTURAL AND COMMERCIAL INFORMATION.

Landlords can also offer their tenants tourist and cultural information, as well as privileged access to the concierge service with a subscription closest to the premises.

IV - HOW TO REGISTER FOR YOU CHECKINN SERVICES

To take advantage of the services offered by YOUCHECKINN ®, an individual must create a free account, either via the website or through the mobile app.

The individual must be at least 18 years of age and have the legal capacity to subscribe to and use the YOUCHECKINN ® services in accordance with these General Terms and Conditions.

He/she undertakes to provide accurate information, which he/she promises to update immediately in the event of any changes. They certify that the information shared concerning their identity, date of birth, place of residence, profession, mobile number and email address is true and correct. They also certify that the identity document whose number they provide when registering is valid and belongs to them personally.

Access to the newly created account is protected by an identifier and password determined by the individual when registering on the site. You are solely responsible for any use that may be made of your login and password, and are solely responsible for guaranteeing their confidentiality, as well as any use of your account, including any action from the sub-accounts associated with the main account. These identifiers and passwords are strictly personal and may not be shared or transferred to third parties. A copy of these will be sent to the individual by e-mail after registration.

If the information shared at the time of registration is incorrect or incomplete, registration for and use of the services will be rendered impossible.

If the individual provides incorrect, false, outdated or incomplete information, CONTROLH SAS has the right to suspend or close his account and to deny him, for the future, access to all or part of the Services.

By registering, the individual authorises CONTROLH SAS to electronically transmit the identification documents on his behalf to an associated Commissioner of Justice, who will draw up a statement of deposit in his office on his behalf. 

V - ACCESS TO YOU CHECKINN SERVICES

Access to the Services is strictly reserved for registered Users.

Users are personally responsible for setting up the IT and telecommunications resources required to access the services. They remain responsible for telecommunication costs incurred when accessing the Internet and using the site.

The services are accessible 24 hours a day, 7 days a week for all Users, provided they have an active internet connection, whether via a 3G/4G/5G mobile network, wifi or a wired connection such as ADSL or optical fibre.

CONTROLH SAS cannot be held responsible for any malfunction of its services if the User encounters difficulties accessing the Internet by the means it has set up, since the service works by transmitting data over the Internet between the access terminal supporting the mobile application or using the Website.

CONTROLH SAS reserves the right, without prior notice or compensation, to temporarily or permanently close the Site or access to one or more services in order to update, change or modify operating methods, servers and access times, without this list being exhaustive.

CONTROLH SAS reserves the right to make any changes and improvements to the Site and Services that it considers necessary or useful for the proper functioning of the Site and Services.

Any request made through YOUCHECKINN ® services does not involve direct input from the Judicial Officer, who will only be engaged within the limits of this mandate, conferred by the acceptance of these T&Cs/GTC and the service provision agreement concluded with CONTROLH SAS.

VI - USER OBLIGATIONS

VI-1 Users must comply with all applicable laws and regulations.

VI-2 Users undertake not to share content that is illicit, contrary to public decency or infringes the rights of third parties. They must respect property rights and image rights.

VI-3 Users must authorise geolocation and not alter the application or its content.

VI-4 They must refrain from disrupting the access of other users or the smooth running of the services.

VI-5 Users are responsible for the accuracy, quality, integrity, and legality of content shared via YouCheckInn ® services.

VI-6 They are liable for any direct or indirect damage arising from the content transmitted via YouCheckInn ® services and any inaccurate or misleading information provided during registration.

VI-7 Users are responsible for the security of their account and must report any unauthorised use or attempted intrusion.

VI-8 CONTROLH SAS retains Connection Logs to establish proof of actions or omissions related to the use of YouCheckInn ® services.

VI-9 CONTROLH SAS and its partner Judicial Commissioner do not validate the legal information or content published via the YouCheckInn ® services. They are not responsible for any legal or tax consequences arising from the use of this content.

VI-10 The information provided by the use of YouCheckInn® services should not be considered personalised legal advice in any way. CONTROLH SAS disclaims all responsibility for the use of energy audit reports or certificates obtained through YouCheckInn® services.

VII - PERSONAL DATA

In accordance with the «Data Protection Act» of 6 January 1978, as amended, the User is informed that YouCheckInn ® automatically processes their personal data when they log in, register, and use the services.

YouCheckInn ® is committed to ensuring the security and confidentiality of this data. It is stored on the servers of 121 SAS, a company specialising in IT hosting.

This data is used to make the services available to the User, as well as for statistical purposes, direct commercial prospecting and the sending of newsletters. It is not communicated to third parties or analysed.

YouCheckInn ® retains User data for the duration of the contract and for up to 30 days after the termination of the contractual relationship. The User may retrieve their files, certificates, and reports during this period.

The User has the right to access, modify, rectify, delete, and object to the processing of their personal data. To exercise their rights, they can contact YouCheckInn ® by email at rgpd@controlh.fr or by post to CONTROLH SAS – You CheckInn, 142 Rue de Rivoli, 75001 Paris, France.

YouCheckInn ® has declared this data processing to the CNIL. User data will be retained for 30 days after their unsubscribe or account closure, in accordance with legal obligations.

In the event of a complaint regarding the use of services, YouCheckInn ® may transmit the User's personal information to judicial authorities upon request.

VIII - PERSONAL DATA

CONTROLH SAS, publisher of the YouCheckInn ® application and website, processes its users« personal data in accordance with the French Data Protection Act (»Informatique et Libertés"). This data is collected during use of the application and is secured and stored by 121 SAS, a French company.

They are used for the purpose of making YouCheckInn ® services accessible to users, as well as for statistical, commercial prospecting and newsletter distribution purposes. The data is not communicated to third parties and users have the right to access, modify and delete their personal data by contacting ControlH SAS.

IX - LIABILITY AND SAFETY

CONTROLH SAS cannot guarantee the compatibility of YouCheckInn ® Services with certain firewalls or pop-up blocking utilities.

The User acknowledges the risks associated with the use of the Internet and is responsible for the use of information exchanged. CONTROLH SAS declines all responsibility in the event of non-functioning of the Services due to unsuitable equipment, malfunctions of the access provider or other reasons beyond its control.

The permanent availability of the Services is not guaranteed. CONTROLH SAS implements security measures to protect data, but there is an inherent risk in using the Internet.

X - APPLICABLE LAW AND JURISDICTION

These GCU/CGV are governed by French law and any dispute relating to these conditions will be subject to the jurisdiction of the Paris courts.

XI - NULLITY - WAIVER

If a clause of these GCU/CGV is declared invalid, this will not affect the validity of the other clauses. The fact that CONTROLH SAS does not exercise its rights does not constitute a waiver of those rights.

XII - PROTECTION OF USER DATA

CONTROLH SAS has declared the collection and processing of personal data to the CNIL. The data collected is used solely for the operation of the YouCheckInn ® application. Users have the right to access, modify, and delete their personal data. Data is kept for a limited time and is neither sold nor exchanged. The Data Protection Officer at CONTROLH SAS is Mr. Pierre MIGNAVAL. You CheckInn ® may use cookies, and the user accepts this use.

A/ PROTECTION OF YOUR PERSONAL DATA

In accordance with the «Data Protection Act», CONTROLH SAS collects and processes your personal data. This information is confidential and is used solely for the establishment of certificates and bailiff's deeds via the YouCheckInn ® application.

B/ SECURITY OF INTERNET BROWSING

CONTROLH SAS implements security measures to protect your information. However, it is your responsibility to protect your password and to exercise caution when using the application. CONTROLH SAS will never ask you for your password by e-mail.

C/ SECURITY OF ONLINE PAYMENTS

Transactions made via YouCheckInn ® are secured by the Stripe payment system. Your payment information is not saved.

D/ SOCIAL NETWORKS

CONTROLH SAS is present on social networks such as Facebook, Twitter, YouTube and Instagram, Linkedin and Tik tok. Be vigilant and never give out your password or other confidential information in response to fraudulent requests.

E/ CHANGES TO THE CONFIDENTIALITY POLICY

CONTROLH SAS reserves the right to modify its confidentiality policy, and users will be informed accordingly.
